Terms of Sale
1. Purpose of the Agreement
This contract pertains to the nightly rental of a private villa named “Villa Sabaou,” located at 2 avenue Cam d’André 64200 BIARRITZ, classified as “5-star furnished tourist accommodation” by Etoiles de France, rented by the villa’s owner (“the Host”) to transient clients (“the Guest”). By booking the villa, the Guest agrees to the terms of this rental contract.
The Villa offers approximately 200 m² of living space over two levels (ground and first floors), accommodating 8 people in 4 separate bedrooms. It includes:
1) Interior:
- Ground Floor: entrance with closet (including baby bed), WC, lounge-dining area (table for 8, piano, library with TV and sound system, two sofas, coffee table, armchair, relaxation space between two wine cellars), fully-equipped kitchen (espresso and coffee machines, Thermomix, induction cooktop, oven, dishwasher, fridge, tableware and utensils), fireplace between kitchen and living room, pantry (American-style fridge, washing machine, dryer, microwave, vacuum cleaner, ironing board and iron), bedroom (160 cm bed) with TV, desk, dressing area (including baby highchair), and bathroom.
- First Floor: mezzanine with office space leading to a balcony, two bedrooms (160 cm beds) with desks and dressing rooms (one with balcony access), independent bathroom with WC, master suite (180 cm bed) with dressing table, dressing room, bathroom (bathtub and shower), and terrace access.
The owner emphasizes the danger of the concrete staircase leading upstairs, which has no railing. The Guest acknowledges this risk and accepts personal responsibility, holding the Host harmless in the event of an accident. Upon request, a child safety gate can be installed at the top of the stairs.
The house is fully air-conditioned with Wi-Fi access. Linens and beach necessities are provided. Final cleaning is included.
2) Exterior:
- Street side: paved courtyard parking for two vehicles (with external electrical outlet), automatic gate (digital code on the left pillar), digital key box containing the house key (same pillar, courtyard side), garden furniture (table and 4 chairs).
- Pool side: garden with heated pool (8.5m x 2.5m x 1.5m deep, with counter-current swimming system and submerged security cover), spa, covered terrace with furniture (extendable table, 8 chairs, bench, two high tables with 8 high chairs, plancha grill, 2 armchairs, and 8 deck chairs).
The Guest will not have access to the pool’s technical room, garage, rooftop terraces, and certain locked cupboards and wine cellars inside the villa.
2. Reservation
The Guest submits a booking request online at www.villa-sabaou.com, providing identity, purpose of stay, number of guests, and payment card details.
Reservations become effective upon Host confirmation, at which point a 30% deposit of the total rental cost is charged.
The remaining balance is charged no sooner than 8 days before arrival.
Payments are accepted exclusively by credit card (Visa, Mastercard, American Express, Apple Pay). Checks are not accepted.
Cancellation policy:
- More than one month before arrival: full refund of deposit.
- Less than one month before arrival: deposit is non-refundable.
3. Duration
The rental period is specified during booking and cannot be extended without prior written consent from the Host. Arrangements for check-in procedures (inventory, key handover, and final payment) will be made between the Guest and the Host. Autonomous arrival may be possible with prior Host approval.
4. Rent
Rent amount, set during booking, covers the full rental period, including rental charges and provided supplies. A 30% deposit is charged upon booking confirmation; the balance is charged one week before arrival. A tourist tax (€4.75 per adult per night as of 2024) is charged additionally.
The Host agrees to provide a payment receipt.
5. Security Deposit
A pre-authorization (not charged) of €3,000 is required as security against potential damages. This deposit is released upon confirming no damages, or after settlement for any necessary repairs or replacements. If damages exceed the deposit, the Guest must cover the additional costs. Unresolved disputes will be settled by the competent local court.
6. Inventory and Condition Reports
A mutually agreed inventory and condition report will be conducted at check-in and check-out. If a mutual inspection is not possible (e.g., autonomous check-in), the Host provides photographic/video evidence within 24 hours of Guest arrival. Without Guest contestation within 24 hours, this evidence is deemed accepted.
7. General Conditions
- Maximum occupancy: 8 persons unless otherwise agreed.
- Pets are generally not permitted.
- Check-in from 4 PM; late arrivals require notification unless autonomous arrival is prearranged.
- Check-out by 11 AM.
- Guests must use the premises respectfully, maintain property condition, and report equipment issues within 24 hours of occupancy.
- Smoking is prohibited inside.
- Guests must avoid disturbing neighbors. Excessive noise complaints may result in immediate termination without refund.
- The villa is rented fully furnished; Guests must replace or reimburse any items lost or damaged.
- The Host must be informed promptly of any equipment malfunction. No rental reductions apply to urgent repairs by the Host during occupancy.
- Guests are recommended to obtain travel insurance. Host liability excludes personal property loss, theft, or damage due to utility outages beyond their control.
In case of dispute, parties will seek an amicable solution; otherwise, the Bayonne court holds exclusive jurisdiction.
Host acceptance of booking requests confirms mutual acceptance of this contract.
